FOD: Jack Booted Thugs




A standoff between police officers and a local business owner that drew several law enforcement officers, fire personnel and other first responders to the center of town, ended with the shop owner’s arrest Saturday night on a public intoxication charge. At 7:50 p.m. Saturday, a man placed a 911 call to report a possible gas leak at shop in the 200 block of Water Street. The caller was a friend of the 42-year-old man who owns the shop and was inside it. 
The caller expressed concern that the shop owner had been drinking and may be depressed to the degree that he posed a danger to himself.
The Kerrville Police and Fire Departments responded to the shop, but the owner reportedly refused to come out or allow authorities to confirm the safety of the premises.
After more than an hour of negotiations, the shop owner refused to exit, and members of the Hill Country Combined Special Operations Unit were ordered to take him into custody. 
As the man stood in the shop’s open doorway, a projectile weapon that shoots bean bags was deployed against him, according to an officer on-scene. Officers then entered the shop, wrestled the man to the ground and handcuffed him. He was taken to Peterson Regional Medical Center for evaluation, and the shop was secured. 
There was no sign of a gas leak or other public safety hazard, according to an officer on scene. Authorities left the area shortly after 10 p.m. 
The shop owner was booked at the county jail on a public intoxication charge between midnight and 1:30 a.m. Sunday, according to county records. 
Public intoxication is a class C misdemeanor. Officers may issue citations for the offense, which is punishable by fine only (not to exceed $500) upon conviction. However, a peace officer may conduct a warrantless arrest if it’s deemed necessary for the protection of the suspect or others, or if the offense is “against the public peace,” according to the Texas Code of Criminal Procedure.

So, their whole premise for being there was bullshit. I guess the jack booted thugs in the Federal Government are not the only ones Americans need to worry about. Not much of a friend either. Call the cops instead of going over and checking on him your damn self? That 'friend' deserves an ass whoopin.

Reminds me of the infamous Tater Salad incident.

Public intoxication?!? The guy was inside his shop when the cops showed up, and he never went outside, correct?

Nope. Y'all need to discern the difference between what is an acquaintance from a trusted friend real fucking quick.

It's a new world now, and if one is dumb enough to obstruct the response to a reported gas leak/wellness check by a "friend" at a place of business (public record), then one can expect to be charged with something.

Fuckitol, it was his business (a welding shop) he lives up top (so it is also a private residence) he was drinking beer (which the police now say was not a reason they were there), some asshat saw propane bottles taped together (which he does to keep them from getting knocked over and rolling around) and called the cops. Instead of walking up and talking to the guy. They sent in the swat team after he refused police entry without a warrant. Now he has ten stitches and a broken hand. Being a welder by trade a broken hand means he can't work. KPD screwed the pooch on this one. I would sue the shit out of them.

That is indeed disappointing. I thought K-town had more common sense.
Why couldn't one law dog just go talk to the guy? Go in, alone, make a cursory check of the area and eave the guy to drown his sorrows.
I'd weld that "friend's" car doors shut or something for that.

I thought no warrant meant no entry. I guess I thought I was living in the United States of America.

I'm sure the ambulance chasers are already knocking on his door.

Sorry dude, but upon escalating the response legally requiring closure, any assertion of "suing the shit out of them" has lost legal grounds as it stands with current Texas Statutes. Sure, some shyster out there would willingly/gladly file said lawsuit as that "profession" charge by the hour even when knowing it's a dead end procedure. Hey, their counterpart public attorneys need work too! Boni judicis est ampliare juris-dictionem. All Hail John RobertsCare!

kerrcarto, I don't like this anymore than you do. The guy got fucked. I do not recognize this nation that I grew up in from a half century ago. However, I do recognize what is smart, and more importantly, necessary to survive free from incarceration in this land of ours plagued with Third world problems in a First world nation seeing its twilight. Foremost is shitcanning acquaintances, as I have stated the obvious reason in comment above, and elsewhere on here. Learn from that welder's mistakes in Kerrville. Malicious obedience has a natural way of settling injustices performed by "some asshat" invoking the force of government. Asshat's are known to talk a lot. Loose lips sink ships.

We are indeed in a cold civil war right now, and if one is clean, then one is able to advance a resistance to the tyranny of a totalitarian state. Providing the state excuse for ones induction to their penile system only serves to enable the oligarch cradle-to-grave agenda. By the way, have I shared with you that Communist haven't existed since the one or two McCarthy exposed?

Fuckitol, the KDT are stenographers for the police. They don't ask any questions, just take statements. They are interested in the truth about as much as Obama supporters are. They haven't even bothered to interview the shop owner. The morning DJ on a local station did. He had a completely different account of how things went down. Who to believe? Either way it needs an outside investigation.
